Can a Licence Be Revoked or Suspended?
The Department may revoke or suspend an operator's licence if he has failed to comply with any of the conditions on his licence.
The Department shall also revoke an operator's licence if at any time the Department becomes aware that the holder of the licence no longer satisfies the requirements on good repute, financial standing or professional competence.
If the Department decides to revoke or suspend your Road Freight Operator's Licence you will receive a notice stating the reasons for the decision. The revocation or suspension will take effect 28 days from the notice. You will, however, have the right, within those 28 days, to appeal to the County Court, giving notice to the Department of your intention to appeal. If you do so, the revocation or suspension will not take effect until the appeal has been determined.
In serious cases a convicted person, partner or director of a company may find it difficult to persuade the Department that an operator's licence should be granted.
If the Department decides to revoke or suspend a vehicle Licence you can write to the Department within 14 days asking for your case to be reviewed by the independent Review Body.
